1.1   Introducing cavadirect

We are a unique internet based wine sales operation specialising in Cava Spanish Sparkling Wine.  Cavadirect has formed close working relationships with key producers to provide a list of wines supplied directly from those partner producers.

1.2. How cavadirect is different from other sites

Our range of Cava wines are supplied directly through our partner producer distribution operations providing for a reliable distribution process, quality of product and continuity of supply. 

We are passionate about Cava and believe that knowing  more about where the wines come from, the grape varieties and wine styles, can enhance your wine drinking experience. Cavadirect actively resources all the products on its list and continues to form links with key producers to broaden the quality and varieties of Cava available through cavadirect.

We aim to offer the most competitive prices available on the internet for all our wines. We do not artificially increase our prices so that we can pretend to offer huge discounts. We pass on directly to our customers discounts and product promotion price reductions made to us by our key producer partners. All prices are offered in £ Pounds Sterling and inclusive of UK VAT.

1.3 Sourcing wine not offered on the site

Cavadirect will use its excellent relationships with wine producers and wine agents to try and locate particular wines with a view to being able to provide the product through cavadirect where possible.

2. How to order wines on cavadirect

We hope to make your shopping experience with us as easy as possible. Please follow these steps to buying on cavadirect.com

2.1 Searching for wines

Start at the home page to begin your shopping with cavdirect.com. On the left hand side you will find a list of categories detailing types of cavas and products.  Click on the category  to display the list of products & ndash then click on the product you wish to browse.

We have lots of ways for you to search for wine.  You can search by category, producer or price.   

When you have finished a search and wish to start another one, simply press the Reset key to go back to the original search menu.

Having narrowed the search according to your criteria, the wines will be displayed.

2.2 Minimum purchase on cavadirect


For some of our products there is no minimum purchase although we recommend you order at least 6 bottles. In most instances you can mix cases of different cavas. We use a standard delivery charge based on the number of bottles ordered.  For orders of over 3 bottles please order in quantise of 6 or 12 to make up a full box (the orders can be of mixed wines but you must fill a case of 6 or 12).  If you want to order large quantise please contact us to obtain the best delivery price.

2.3 Saving orders and returning at a later date.

When you  purchase an item you  simply click on the Add to basket icon on the wine detail page and the item will be saved to your basket.  When you click on Add to Basket you will be taking to a Shopping Basket page where you can view your selections so far and decide whether to Continue to Checkout or Continue searching for wines

The value and number of items of your shopping to date is displayed on the screen.  You can either click on this or on the My Basket link in the menu bar on the top right of the page to display the details of your order.  If you want to remove something, simply tick the remove box next to the item in your shopping basket that you wish to remove, and then click the '' update'' button. This will then remove the products which you Ticked to be removed.

Your selections in My Basket will stay there until you delete them.  So you can log off and return to finalise your wine purchase  at a later date.

2.4  Sending a greeting with your order.

At the checkout stage of completing you order you can choose to send a personalised message with your order.  The greeting will be attached to the delivery documentation of your order.

2.5 Completing a purchase.

When you have all the items you wish to purchase in your basket, it is recommended that you read the terms and conditions, delivery information and privacy policy, then go to your basket and click the checkout button which will then take you to the payment area to pay for your selected items.

To order on the web:

You will first need to register your details and create an account within the online shop. Registration is quick and easy. If you have previously registered you need only to enter your name and password to continue, this will then pre-fill most of the checkout requirements for you based on the information supplied during previous orders and the details stored in your account with the shop. Otherwise you will need to set up a new account by filling in the simple form provided.

For your convenience, you may enter an alternative delivery address and any other specific details on the account and checkout pages in the applicable areas which are clearly represented.   

2.6. Age Restriction

We will not sell to anyone who is not 18 years of age or over, as the law requires.
By placing an order you confirm that you are at least 18 years old.
If you are buying a product/s as a gift - the recipient must also be over 18 years old.
If our couriers are in any doubt about the age of the recipient on delivery, they will request some form of ID.
If the person receiving the order is unable to produce appropriate ID, unfortunately our couriers will be unable to leave the products.

2.7 Security of payments.

All payments to Cavadirect are secured by the PAYPAL Website payments gateway.   Your payments are very safe.

We recommend that you check the details of the items you are ordering before making your purchase. Clicking on the Continue button takes you through the required pages to the point at which you can enter your payment details and complete your order securely. You will need to choose from one of the card types that we accept for payments. We accept MasterCard, Visa,  Switch and Debit cards,


2.8 Reordering a wine but have forgotten the name.

All your order details are stored with your details.  These include not only the wines you have ordered for your personal consumption but those you have sent to friends as well.  You can reorder any of the wines you have purchased with a simple click of the ReOrder button.

3.  Delivery with cavadirect

3.1 UK delivery charges

Depending on our arrangements with our producers we are able to offer alternative forms of delivery, either using our producers own distribution operation or through a UK national courier/distribution service.  Please note that large orders made up of products from different producers may be dispatched separately directly from the producers own warehouse to reduce delivery charges but we can not guarantee delivery at the same time.

Please note that the following standard delivery charges apply for UK retail orders :

  • UK deliveries are undertaken by Clearwater ltd using DHL: £ 8.00 for the first bottle and then 85pence for every bottle there after. 1 case of 6 costs £ 12.25 and £ 17.35 for 1 case of 12 (per address).  Large orders of 10 cases or more from some produces can be delivered free of charge.  
  • We are happy to deliver to the Channel Islands,  the Isle of Man, the Isle of Wight, Northern Ireland, the Shetlands and Orkneys.  These orders do take at least 3-5 days for delivery.
  • We do not offer guaranteed next day delivery - However, if you contact us as early as possible the day before delivery is required we will do our best to arrange this for you. There is an additional £ 19.99 on top of the standard charge.

3.2 Delivery times

Orders received by 1pm will be despatched the same day and  in most cases delivered the next day  .  Standard delivery timeframe is 3-5 days provided that the item is in stock.

It is our policy to stock all items which we list on our website and to ensure that our suppliers are able to restock every week.  Due to the number of premium wines listed on our site it may be the case that several people have ordered cases of the same wine over 1-2 days and therefore we will not be able to fulfil the order until the next delivery from our supplier.

If a particular wine is in high demand and is out of stock we will contact you only if delivery of the item is likely to take more than  7 days. In these rare cases we will advise you of the delivery time frame we can meet, or recommend an alternative wine or refund your payment if you do not want to proceed with the order.

Orders for Northern Ireland, Scilly Isles, Isle of Man, Scottish Highlands and the Orkneys &   Shetlands please allow 3-6 days.  It may also take longer to deliver to remote areas & ndash including the following post codes: AB, BT, DD 8-11, HS, IV, KA 27-28, KW, PA20-23, 28-29, 31, 34, 41 onwards, PH8, 10, 16, 18 onwards, TR21-25, ZE.

If you need the wine for a particular date, or before a particular date please make sure you mention this in the comments section when placing your order.

After you have placed your order online, we will send you an order confirmation email with the subject Thank you for your purchase at cavadirect. In the email you will find information about when your products will be delivered.

3.3 What if no one is home to meet the courier?

If no one is home, the courier will leave a card to say she/he has been. Alternatively, you may authorize the courier to leave the order in a certain place. There is a textbox in the shopping checkout where delivery instructions can be left should no one be home to meet the courier. Let us know if you want the courier to leave your order in a certain spot (e.g. at back door or in shed etc). IMPORTANT NOTE: if a request is made for wine to be left unattended we cannot be held responsible if the wine goes missing after the courier has delivered it. 

3.4 Returns

We are committed to giving you complete satisfaction. If you are not completely satisfied with any cavadirect product, simply return it within 28 days of receiving it, and we will promptly issue a refund for the value of the item, or replace the product (your choice) free of charge.

It must be in a saleable condition in its original, undamaged packaging, and we will consider the overall condition when making a refund (this does not affect your statutory rights in the event of faulty goods).

If you intend to return any part of your order, please e-mail us at returns@cavadirect.com then return the goods along with a letter explaining why you are returning the product and enclose it with your shipment. Carefully secure and package the merchandise to prevent damage in transit (the package with remaining product must be returned). Please do not return any goods unless you have contacted us for the returns authorisation and the delivery address to our distribution centre.

If there are breakages in transit please save the merchandise and the package it arrived in and notify us immediately.

Please note: All exchanges or returns must be shipped  within 30 days of receiving your order together with a letter detailing why you are returning the product. Shipping and handling charges are NOT refundable unless the goods delivered were incorrect, damaged or faulty.

3.5 Ordering from overseas or requesting an overseas delivery

Cavadirect can deliver within the Europe at standard international courier rates.

The cost of sending items overseas is calculated by weight, this is a list of prices for sending standard wine packs to EC Europe and Non EC Europe, these delivery prices include the packaging at 80p per bottle, the VAT is shown in brackets and needs to be added where applicable.

4.  Terms and Conditions

All orders are subject to our full terms and conditions of sale which are available on request.

4.1 General Terms

Placing an order

All prices will be charged at the published price list current at the date of order, and include VAT where applicable. No charge is made to a consumer for credit card payments. We accept MasterCard, Visa, American Express,  Debit  and Switch cards, personal cheques and bank or building society cheques (all cheques made payable to " cavadirect Ltd" ). Goods ordered by post, telephone or fax will be priced at the current price on the day they are received.

Force Majeure

Neither party shall be liable for any default due to any act of God, war, strike, lock-out, industrial action, fire or other event beyond the reasonable control of either party.

Law

All disputes arising out of this contract shall be subject to the jurisdiction of the Courts of England and Wales.

Delivery

In the case of goods purchased by credit card, those goods can only be shipped to the credit card holders address (in order to protect you, we carry out extensive checks to ensure that your card is not being used fraudulently) and must be signed for on delivery.

Price & Special Offers

All goods are offered subject to availability. Prices are correct at time of publication. Errors and omissions are excepted.

Photographs of Products

Photographs are for illustrative purpose only.  The vintage featured may not be the same as the one on sale.  On rare occasions we may show a picture of a similar wine from the same producer rather than that on sale.

Standard Conditions of Sale

DEFINITIONS 1. " Buyer" means the person who buys or agrees to buy the Products from the Seller. 2. " Conditions" means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller. 3." Delivery date" means the date specified by the Seller when the Products are to be delivered. 4." Products" means those goods specified. 5." Price" means the price for the Products including carriage, packing and VAT. 6." Seller" means Cavadirect  Limited. 7." Consumer" shall bear the meaning ascribed in section 12 Unfair Contract Terms Act 1977.

CONDITIONS APPLICABLE 1
. The Seller shall sell and the Buyer shall purchase the products in accordance with any written quotation of the Seller which is accepted by the Buyer, or any written or verbal order of the Buyer which is accepted by the Seller including but not limited to orders placed using the Seller'' s electronic on-line ordering service, subject in any case to these conditions, which shall govern the contract to the exclusion of any other terms and conditions subject to which any such quotation is accepted or purported to be accepted, or any such order is made or is purported to be made, by the Buyer. 2.Any variation of these conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller, acting by its Managing Director or some other person authorised in writing by him. 3.Any typographical or clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by the Seller shall be subject to correction without any liability on the part of the Seller. 4.If any provision of these conditions is adjudged invalid or unenforceable in whole or in part the validity of the other provisions of these conditions and the remainder of those provisions in question shall not be affected.

THE PRICE AND PAYMENT 1. Save as provided otherwise herein the price shall be that as stipulated in the Seller'' s published price list current at the date of order of the Products. Any event of any increase in the cost to the Seller of raw materials, labour, overheads, or any increase in taxes or duties, or any variation in exchange rate the Seller may increase the price payable under the contract upon written notice. 2. Payment of the price shall be due at the date of the order. Time for payment shall be of the essence. If the Buyer does not pay the Price on notification of shipment the Seller may bring an action for the price even though property in the Products has not been passed to the Buyer. The Buyer will pay the price in full without discount (except any discount allowed by these terms) deductions, set off or abatement on any ground. 3. Interest on overdue invoices shall accrue from the date when payment becomes due from day to day until the date of payment at the rate of 2% above Barclays Bank Plc base rate from time to time in force and shall accrue at such a rate after as well as before any judgement.

THE PRODUCTS 1
. The quantity and description of the Products shall be set out in the Seller

  Quotation. 2. The Seller may make any changes in the specification of the Products which do not materially affect their quality or performance required to conform with any applicable statutory requirements where the Products are supplied to the Seller'' s specification. 3. Cancellation of an order by the Buyer which has been accepted by the Seller will result in forfeiture by the Buyer of his deposit. The Seller will however waive this right in respect of orders received upon which manufacture has not yet commenced at the time of notification of the manufacturer by the Seller of the cancellation. In respect of cancelled orders which have entered production at the time of notification of the manufacturer by the Seller of the cancellation, there will be a 15% (of the total order value) re-stocking charge deducted from the deposit, the balance of which shall be re-paid to the Buyer.

WARRANTIES AND LIABILITY 1. All goods supplied by the Seller come with a manufacturer warranty of at least 12 months. 2. The Seller shall provide the Buyer with such information as is required to claim under the manufacturer warranties. In the event of a claim, the Buyer shall in the first instance contact the Seller'' s customer service department. 3. The Seller does not provide any warranty cover against defects in his own right. 4. If the Buyer is dissatisfied with his purchase for any reason he may, within seven days of delivery, contact the Seller customer service department to arrange for collection of the goods at the Seller expense. The Buyers account shall then be credited with the full purchase price of the goods. This credit may be used to buy items from the Sellers on-line catalogue. It may not be exchanged for cash. 5. The home trial policy claimed in clause 5.4 is contingent on the proper use of the Products by the Buyer and does not cover any part of the products which have been modified without the Sellers prior written consent, or which has been subjected to unusual physical stress, or where damage has been caused to the goods after delivery as a result of causes other than ordinary use including without limitation accident, hazard, misuse or failure or fluctuation of electrical power, air conditioning, humidity control, transportation or other causes other than ordinary use. 6. Except where the Buyer acts as a Consumer all other warranties, conditions and terms relating to fitness for purpose, satisfactory quality or conditions of the products whether implied by statute or common law or otherwise are excluded to the fullest extent of the law. 7. In any event and despite anything contained in these conditions, in no circumstances shall the Seller be liable in contract, tort (including negligence or breach of statutory duties) or otherwise howsoever, and whatever the cause thereof, (i) for any increased costs or expenses (ii) for any loss of profit, business contracts, revenues or anticipated savings, or (iii) for any special indirect or consequential damage of any nature whatsoever.

THE PRICE AND PAYMENT 1. Delivery of the products shall be made by the Seller or his agent notifying the Buyer that the products are available for collection at the Sellers premises or for delivery to such place as the Buyer may specify at the time the order is placed. 2. The Seller shall use his reasonable endeavours to meet any date agreed for delivery. 3. In any event time of delivery shall not be of the essence. 4. The Seller shall not be liable for any delay in delivery howsoever caused.

ACCEPTANCE OF THE PRODUCTS 1
. Other than where the Buyer acts as a Consumer the Buyer shall be deemed to have accepted the Products 5 working days of delivery to the Buyer. 2. After acceptance the Buyer shall not be entitled to reject Products which are not in accordance with the contract.

TITLE AND RISK 1. Risk of damage to or loss of the Products shall pass to the Buyer upon delivery. 2. Notwithstanding any other provision herein title in the Products shall not pass to the Buyer until the Seller has received in cash or clear funds payment in full. 3. Until the property in the Products passes to the Buyer the Seller shall be entitled at any time to require the Buyer to deliver up the Products to the Seller and, if the Buyer fails to do so immediately, to enter any premises of the Buyer or any third party where the Products are stored and repossess the Products. 4. The Buyer shall not be entitled to pledge or in any way charge by way of security for any indebtedness any of the Products which remain the property of the Seller, but if the Buyer does so all moneys owing to the Seller shall (without prejudice to any other right or remedy on the Seller) immediately become due and payable.

REMEDIES OF BUYER
1. Where the Buyer rejects any Products the Buyer shall have no further rights whatever in respect of the supply to the Buyer of those Products or the failure by the Seller to supply Products which conform to the contract of sale. 2. Where the Buyer accepted any Products then the Seller shall have no liability whatever to the Buyer in respect of those Products.

INSOLVENCY OF BUYER 1
. This clause applies if: a The Buyer makes any voluntary arrangements with its creditors or becomes subject to an administration order or (being an individual or firm) becomes bankrupt, or (being a company) goes into liquidation (otherwise than for the purposes of amalgamation or reconstruction) or b An encumbrancer takes possession, or a receiver is appointed, of any of the property or assets of the Buyer, or c The Buyer ceases, or threatens to cease, to carry on business, or d The Seller reasonably apprehends that any of the events mentioned above is about to occur in relation to the Buyer and notifies the Buyer accordingly. 2. If the Clause applies, without prejudice to any other right or remedy available to the Seller, the Seller shall be entitled to cancel the contract or suspend any further deliveries under the contract without any liability to the Buyer, and if the Products have been delivered but not paid for the price shall become immediately due and payable that despite any previous arrangement or agreement to the contrary.

GENERAL 1. Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control and the party shall be entitled to a reasonable extension of its obligations. 2. Any notice required or permitted to be given by either party to the other under the conditions shall be in writing addressed to the other party at its registered office or principle place of business or such other address as may at the relevant time have been notified pursuant to this provision to the party giving notice. 3. Each party agrees to treat as conditional and not to divulge to any third party without the prior written consent of the other, details of the others business operations, proprietary rights and techniques, contemplated new products and customer lists. This obligation does not relate to information which is or becomes public knowledge through no fault of either party or has been properly obtained from a third party lawfully entitled to possess the information.

HEADINGS The headings of the Clauses in these conditions are intended for reference only and will not affect the construction of these conditions.

PAYMENTS If the Buyer fails to make any payments in accordance with the terms and provisions hereof the Seller, in addition to its other rights and remedies but not in limitation thereof at its opinion may defer shipments or deliveries hereunder upon receipt of satisfactory security or of cash before such shipments or deliveries resume.

CONSEQUENTIAL LOSS The Seller shall not be liable for any costs claims damages or expenses arising out of any tortuous act or omission or any breach of Contract or statutory duty calculated by reference to profits income or accrual or loss of such profits income production or accruals or by reference to accrual of such costs claims damages or expenses on a time basis, to the fullest extent of the law.

REPRESENTATIONS No statement, description, warranty condition or recommendation contained in any catalogue, price list or advertisement or communication or made verbally by any of the Agents or Employees of the Seller shall be construed to enlarge, vary or override in any way thereof any of these conditions.

FORCE MAJEURE The Seller shall be entitled to delay or cancel delivery or to reduce the amount delivered if it is prevented from or hindered in or delayed in manufacturing, obtaining or delivering the products by normal routes or means of delivery through circumstances beyond its control including but not limited to strikes, lock outs, accidents, war, fire, reduction in or unavailability of power at the Sellers premises or its manufacturing plant, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply.

ADDITIONAL COSTS The Buyer agrees to pay for any loss or extra cost incurred by the Seller through the Buyers instructions or lack of instructions or through failure or delay in taking delivery or through any acts or default on the part of the Buyer, its servants, agents or employees.

RIGHT OF PARTIAL REJECTION LIMITED Section 35 (A) of the Sale of Goods Act 1979 (as amended) shall not apply (there shall be no right to partial rejection).

TERMS TO BE APPLIED WHERE THE BUYER DOES NOT ACT AS A CONSUMER Where the Buyer acts other than as a customer, for the purposes of Section 35 (2) of the Sale of Goods Act 1979 (as amended) the reasonable opportunity of examining the goods delivered under each Contract shall be five days upon delivery and Section 15 (A) of the Sale of Goods Act 1979 (as amended) shall apply.

PROPER LAW OF CONTRACT
This Contract shall be governed by the law of England and Wales and any dispute, question or remedy howsoever arising shall be determined exclusively by the Country of England and Wales.

At cavadirect.com we promise that your personal information is secure. Every transaction is processed by using the latest industry standards for secure online credit card transactions. Secure servers protect your information using advanced encryption and firewall technology throughout the ordering process. For security reasons credit card information should never be sent via e-mail.

2. a telephone number in case we need to contact you urgently regarding your order or payment
